NZ vs Australia: Where the Requirements Diverge
When a NZ subcontractor wins work on an Australian site, the SWMS they normally produce for a head contractor isn't automatically sufficient — because in Australia it carries legal weight under the WHS Regulations, not just contractual weight.
Under the model WHS Regulations, regulation 291 defines categories of High-Risk Construction Work and regulation 299 sets out what a SWMS must contain. A SWMS for High-Risk Construction Work must be prepared before that work starts — not the day before the toolbox talk, before the work starts.
